How Markandeya Katju compromised India's security
1. When Katju was a judge at Allahabad HC (91-04), he entertained a large number of petitions by Pakistani citizens who had come to India on one-month visas and did not want to go back. Govt of India rightly wanted to deport them.
1. When Katju was a judge at Allahabad HC (91-04), he entertained a large number of petitions by Pakistani citizens who had come to India on one-month visas and did not want to go back. Govt of India rightly wanted to deport them.
2. These Pakistanis brazenly challenged India's deportation order. In each case, Katju would pass a stay order staying their deportation "till further orders". Since there are 10 lakh cases in HC, a case which had been heard once would usually be listed again after several years.
3. This is a High Court judge boasting how he twisted Indian law. Not only does he come across as a law breaker, he fails to see the irony of a judge crowing about the lethargy and failure of the Indian judicial system. 10 lakh pending cases and he wears it like a badge of honor.
4. Katju says: "So the result of my stay orders was that in effect by a judicial order I converted a one month visa into a 5 year one or so (because the case would come up again after 5 years or so, and till then the stay order would continue).
5. Why did he do this? "I do not recognise Partition, which was a historical swindle by the British on the basis of the bogus two nation theory, to keep Hindus and Muslims fighting each other, and thereby keep India, of which Pakistan is really a part, weak and backward."
6. This is classic dhimmitude of seculars. Reality of Partition is Pakistanis (and Bangladeshis) are clear about the two-nation theory. They fought for it and they believe they did the right thing. They laugh at Indians like Katju who mindlessly repeat "we are the same people".
7. "So I regarded these petitioners before me as Indians. When they had been young men at the time of Partition they had been carried away by religious passions, incited by our British rulers or their agents, and in that fit of passion they migrated to Pakistan."
8. "But now they had become old, and were nostalgic and wanted to return to their native homes where they had spent their young days, and where many of their relatives still lived. Unfortunately, on migrating to Pakistan they lost their Indian nationality, and became Pakistanis."
9. "These old men (and women) had come on this short visa, and were reunited with their relatives and old friends, and wanted to spend the last days of their lives here. They realised the folly of their youth, but it was too late now, what could they do?"
10. Katju is lying. Many of these illegal aliens were from Kerala. They had voted for the breakup of India. There is absolutely no evidence they felt any remorse for what they did. Yes, many Indian Muslims regret moving to Pakistan, but have zero regrets they created Pakistan.
11. Katju quotes from 'Mohajirnama' by the radicalised Munawwar Rana, whom he describes as a great Urdu poet: "In poignant verses, which bring tears to one's eyes, Rana writes, Bhateeji ab saleeke se dupatta odhti hogi Wahi jisko jhoole mein humakta chhod aaye hain and...
12. "....Moharram mein hamaara Lucknow Iran lagta tha Madad Maula Husainabad rota chhod aaye hain and Gale milti huin nadiyaan, gale milte hue mausam Allahabad ka kaisa nazaara chhod aaye hain."
13. "Many of these Mohajirs have their ancestors' graves in India, and would have liked to have their own graves too near their ancestors. They wanted to spend the rest of their lives in the land of their youth..... So, naturally, they wanted to stay on."
14. "So I regard all Pakistanis as Indians. When a Pakistani comes to India, it is really an Indian who has come to India. How then can he be deported from India? Of course, I did not say this in my orders, but this was really what was in my mind while passing such orders."
15. Justices like Katju are rorting law and order. They give bail to urban naxals at 3AM, stay hanging of dreaded terrorists but allow Sadhvi Pragya Thakur and Lt Col Purohit to be tortured in jail for years on fake charges. The nation deserves better judges.
